The process
of creating, amending or abolishing laws in the EU is a long and complex
procedure. It involves different actors: the European Commission, national
parliaments of member states, the European Parliament and the Council of the
European Union. While the Commission’s main role is initiating laws, the
European Parliament and the Council of the EU are responsible for scrutinizing
and amending legislation. In order to pass a law propositions need to be
approved by both the European Parliament and the Council of the EU, which have
equal importance in EU law. In the event of an objection to a new law by a
member state national parliaments have a delaying power. A distinction is made
between ordinary legislative procedure, which applies to numerous areas
including agriculture and EU budget, and special legislative procedure used in
sensitive areas. The European Parliament, the Commission and the Council of the
EU are also in charge of revising the European Treaties that are comparable to national constitutions
and are therefore the basis for all EU legislation.
